InterAmerican Treaty on Letters Rogatory done in Panama on January 30, 1975, which entered into force in the United States on August 27, 1988, establishes a means by which judicial documents can be served by a particular method consistent with the laws of its member nations. The InterAmerican Treaty on Letters Rogatory (18 International Leg. Mat., 1238) is a multinational agreement that prescribes methods for transmitting judicial and extrajudicial documents for service abroad.
The original treaty, as it was adopted in Panama, was determined to be insufficient by the U.S. Department of Justice. To satisfy the United States’ requirements, it drafted and proposed to the OAS (Organizations of American States) the Additional Protocol, which was adopted at Montevideo, Uruguay on May 8, 1979. The United States reciprocates only with those countries party to both the InterAmerican Treaty and the Additional Protocol.
Of the 200 plus nations in the world, thirteen nations are parties to the InterAmerican Treaty and the Additional Protocol. Of those 13, four countries, Argentina, Mexico, Venezuela and the United States are parties to both the InterAmerican Treaty and the Hague Service Convention.
