This is course is a primer for attorneys and paralegals who must exercise proper jurisdiction over a defendant in a foreign country. Service of process abroad presents many risks that are either obscure or insoluble or both. This course will introduce you to and provide practical solutions for most of these hazards.
The course will cover the following topics:
- Commencing litigation with a foreign defendant
- Avoiding and prevailing against motions to dismiss and appeals for failure to serve properly
- Methods of service in various countries
Course materials include:
- The applicable FRCP you need to know
- The methods of proper service in each country in the world
- The text of the process treaties including the required forms and the treaty exceptions of the member nations
- How to sue a foreign sovereign or corporation in a communist country
- How to begin your action so you can get to the defendant’s assets anywhere in the world after judgment
